Terms and Conditions

These Terms and Conditions (“Terms”) govern your participation in and use of the Letting the Light in online breathwork program (the “Course”), provided by The Lily Flower by Priyanka, a registered business name owned by The Trustee for WP Calvert Family Trust (ABN 92 727 403 070) (“we”, “our” or “us”). By enrolling in or accessing the Course, you agree to be bound by these Terms. If you do not agree, you must not participate.

1. Definitions

  • “Course” means the online breathwork program, including all live sessions, recordings, written materials, exercises, and community components.
  • “Participant” or “you” means the individual enrolling in the Course.
  • “Waiver” means the Informed Consent and Liability Waiver that must be signed before participation.

2. Eligibility

  • You must be at least 18 years of age to participate.
  • By enrolling, you represent that you have the legal capacity to enter this agreement.
  • Participation is conditional on signing and returning the Waiver before the Course commences. Failure to do so will result in denial of access.
  • You must have sufficient internet access and technology to access the Course platform.

3. Course Access and Duration

  • Upon full payment, you will be granted access to the Course content for the scheduled duration plus an additional 10 weeks.
  • Access is for your personal use only and may not be shared, transferred, or sold.
  • We reserve the right to withdraw access if you breach these Terms.

4. Live Sessions and Attendance

  • The Course includes live breathwork and coaching sessions.
  • If you are unable to attend the Week 3 transformational breathwork session, you may attend one alternative session at our discretion. This option is available once only.
  • By participating in live sessions, you consent to being recorded. Recordings are made available for participant use only and must not be shared.

5. Waiver and Participant Responsibility

  • You must complete the Waiver before you may access any live breathwork or related Course components.
  • You warrant that all information provided in the Waiver is true, complete, and accurate.
  • You agree that it is your responsibility to notify us in writing if your medical, psychological, or personal circumstances change during the Course.

6. Health Disclaimer

  • The Course is an educational and wellness program only. It is not medical advice, therapy, or a substitute for professional healthcare.
  • Breathwork may not be suitable for certain medical conditions. You are responsible for seeking advice from a qualified health professional before participation.
  • You acknowledge and accept that you are solely responsible for your health, safety, and wellbeing in relation to your participation.

7. Assumption of Risk and Release

  • You acknowledge that breathwork and somatic practices may bring up strong physical, mental, or emotional experiences.
  • By participating, you voluntarily assume all risks, including injury, psychological distress, or other outcomes.
  • To the fullest extent permitted by law, you release and indemnify us and our employees, contractors, and representatives from any liability for loss, injury, damage, or claims arising from your participation.

8. Payments and Refunds

  • Payment for the Course must be made in full at the time of enrolment, unless you elect to use an approved Buy Now, Pay Later (BNPL) service at checkout.
  • If you choose to use a BNPL service, your payment obligations are managed under a separate agreement between you and the BNPL provider. We are not responsible for the terms of that agreement, including late fees, penalties, or suspension of your account.
  • Your access to the Course is conditional on successful payment confirmation through your chosen payment method or BNPL provider.
  • All sales are final. No refunds or exchanges will be offered for digital products, Course access, or missed sessions, except as required under the Australian Consumer Law.

9. Intellectual Property

  • All Course content, including videos, audios, written materials, exercises, meditations, and branding, is our intellectual property and protected under copyright law.
  • You are granted a limited, personal, non-transferable, non-sublicensable, revocable licence to use the materials solely for your personal purposes.
  • You must not copy, reproduce, record, distribute, publish, or create derivative works from the Course content without our prior written consent.
  • If we become aware that you have copied, plagiarised, or otherwise misused Course content, we reserve the right to immediately remove you from the Course without refund.
  • We also reserve the right to pursue legal remedies, including damages, costs, and injunctive relief, for any unauthorised use or infringement of our intellectual property.

10. Confidentiality and Behaviour

  • Participants may share personal and sensitive information in live sessions or group forums. You agree to respect the privacy and confidentiality of other participants.
  • You must not disclose, reproduce, or distribute any personal contributions or recordings of other participants.
  • You agree to engage respectfully at all times. We reserve the right to remove any participant who engages in harassment, abuse, plagiarism, or unsafe behaviour without refund.

11. Technology and Availability

  • The Course is delivered via third-party platforms. We are not liable for service interruptions, outages, or technical failures beyond our control.
  • You are responsible for maintaining suitable internet access, equipment, and software to participate.

12. No Guarantee of Outcomes

  • The Course is intended to provide tools and practices for personal use.
  • No representation or guarantee is made regarding the achievement of specific outcomes, including emotional release, healing, or wellbeing improvements.

13. Force Majeure

  • We are not liable for any delay or failure in performance of our obligations if such delay or failure arises from events beyond our reasonable control, including but not limited to illness, natural disasters, government restrictions, internet outages, or other unforeseen events.

14. Amendments

  • We may update these Terms at any time. Updated versions will be published on the Course platform or website.
  • Continued participation in the Course constitutes acceptance of the revised Terms.

15. Governing Law

  • These Terms are governed by the laws of Victoria, Australia.
  • You agree to submit to the exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.

16. Severability

  • If any part of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect.

17. Dispute Resolution

  • In the event of a dispute, the parties will first attempt to resolve the matter through good faith discussions.
  • If the matter cannot be resolved through discussion, the parties agree to attempt mediation in Victoria before commencing legal proceedings.
